A: The Court first seeks to classify and value a couple’s property. There are multiple classifications, each having different legal implications: marital property, separate property, and hybrid property. The Court will also consider a variety of factors in determining how best to divide the marital estate. Under Virginia law, there is no presumption of a 50-50 split of the marital estate.
