Circuit Courts

The Circuit Court is the principal trial court in Virginia. Most personal injury cases are tried in Circuit Court, which are known as “courts of record” because a court reporter usually records the proceeding. Unlike General District Court, juries usually sit on Circuit Court cases. However, if neither party requests a jury, the case will be tried by a judge.

In Circuit Court the parties can engage in discovery to learn information from the other party and from third parties. In most slip and fall cases , it is difficult to establish negligence without conducting discovery. For this reason, most slip and fall cases are filed in Circuit Court instead of General District Court.

There are many Circuit Courts in Virginia. In central Virginia, most cases are tried in the City of Richmond, Henrico County, and Chesterfield County Circuit Courts. The Circuit Courts in the Richmond area maintain some of the fastest dockets in the state. Most cases are usually tried within 9 to 12 months of filing and service.
