Court of Appeals
The Court of Appeals has limited jurisdiction. It generally does not hear appeals for personal injury cases. Rather, it primarily hears appeals of criminal cases, domestic relations cases, and worker’s compensation cases.
Virginia Supreme Court
The Virginia Supreme Court is made up of seven Justices elected by the General Assembly for 12-year terms. The Supreme Court hears every kind of case.
Personal injury appeals are appealed from the Circuit Court directly to the Supreme Court. Appeals are not automatic. Rather, the party seeking review must petition the Court. If the Court decides to consider the appeal, it grants the petition.
Most petitions are denied. It is very rare that the Supreme Court will grant a petition to review a personal injury case. For this reason, it critical to put on the best case possible at the Circuit Court level, because it is highly likely that the outcome of the Circuit Court trial will be the final outcome.
