Damages in a Premises Liability Case

A plaintiff’s personal injury attorney may recover for her client economic damages. These are actual or incurred damages if a defendant is found liable. For example, a plaintiff may recover his criminal defense cost fees in a malicious prosecution action.

A plaintiff’s personal injury attorney may recover for her client non-economic damages. There are several non-economic categories of damages for which a plaintiff can recover, including damage to reputation, humiliation, embarrassment, inconvenience, insult, and mental suffering.

A plaintiff’s personal injury attorney may recover punitive damages for her client. These are sometimes recoverable where the evidence shows a conscious disregard for the rights of others, or in situations involving intentional torts.

Damages in premises security cases are often difficult to predict. Unlike personal injury cases, there are usually no (or few) medical bills to which a jury can “tie” an award. Instead, a jury assesses damages based on noneconomic damages such as humiliation and embarrassment. The amount of damages in a particular case can vary widely depending on the jurisdiction or particular jury pool.
