Under Virginia law, any person who on more than one occasion engages in conduct directed at another person with intent to place that other person in reasonable fear of death, sexual assault, or bodily injury to that person or a family or household member is guilty of a class 1 misdemeanor, punishable by 12 months in jail and a $2500 fine. This definition captures ex-spouses who repeatedly invoke reasonable fear in their previous partners or other members of their households. A third conviction for stalking will result in a class 6 felony charge, which is punishable by 1 to 5 years in prison and a $2500 fine. Whenever a defendant is convicted of stalking, Virginia courts are required to issue a protective order, prohibiting contact between the stalker and stalked party.
