Personal injury is a broad category that applies to all types of cases where a victim is wrongfully injured by the actions of someone else, or even the failure of someone else to act. The most common type of a personal injury case is known as a negligence case. Under Virginia law, everyone has a duty to exercise ordinary care so as to not cause injury to someone else. The failure to exercise this ordinary care is known as negligence.

Negligence can arise in a variety of ways, including:

    false imprisonment

In a personal injury case, the injured person is known as the plaintiff. The person who caused the injury is known as the defendant. The plaintiff can seek money damages known as compensatory damages from the defendant which are aimed at compensating the plaintiff for his or her injury and placing the plaintiff in a position he or she was prior to the injury (as best money can do).

In some cases, such as where the defendant's actions are intentional, or where the defendant was so negligent that it rises to the level of a conscious disregard for another's safety, a plaintiff can seek punitive damages. These are money damages above and beyond compensatory damages. They are aimed at punishing the defendant and serving as a message to others.
