Many car accidents occur that are truly accidents, and are caused because the other driver was distracted by his phone, or in a hurry because he was late to work, or couldn't see because the sun was in his eyes. However, to receive punitive damages, the injured party must prove that the drunk driver had a conscious disregard for the rights of others.  Virginia law holds that one way to do this is to prove that the drunk driver (1) had a blood alcohol concentration of at least 0.15, (2) knew or should have known that his ability to drive was impaired, and (3) that the driver's intoxication was the cause of the injuries. In almost all cases, the drunk driver will have a team of lawyers, paid by his insurance company, who will do everything legally in their power to make sure that the court does not award these extra, punitive damages.
